TERMS AND CONDITIONS

The “Seller” is defined as the legal entity Rashida’s Patisserie. The “Buyer” means the person (legal or natural) who buys the goods. “Goods” is defined as the items to be supplied by the Seller to the Buyer as listed in this invoice.

 

These Terms and Conditions shall apply to the sale of the Goods by the Seller to the Buyer to the exclusion of all other terms and conditions referred except where the Seller has agreed to such variation in writing. By ordering from Rashida’s Patisserie you agree to be legally bound by these Terms and Conditions (“Conditions) and accept that these Conditions may be modified or amended and posted on this website from time to time.

All Products made by us are subject to the following Terms and Conditions.

INGREDIENTS

All cakes, fillings and icings may contain, or come into contact with, soy, wheat, dairy, nuts or other allergens. We always endeavour to keep allergens separate where possible.

It is the responsibility of the Customer to inform me prior to the confirmation of their booking of any allergy issues. It is the responsibility of the Customer to inform their guests of all allergy information and accordingly the Supplier will not be held liable for any allergic reaction resulting from consumption of the cake.

All products are made to be eaten on the day of the celebration. Please see information provided in your order for cake care and best before dates of your order.

Our Goods may contain non-edible ingredients or decorations, such as plastic dowels in tiered cakes or wires in some sugar flowers or non edible flowers. These will be detailed on the Delivery Note and must be removed before serving or eating.

QUOTATIONS

All Quotations are valid for 30 days from the date of issue.

ORDERS

We prefer at least fourteen (14) days notice for all orders, as we are continually booked in advance. We will however endeavor, where availability permits accept short notice cakes. Last minute orders will incur a last minute order fee.

 Allergies

Please let me know if you or any of your guests have any allergies at the point of enquiry. My kitchen in not a nut free environment.

DESIGN

I always aim to create one off cakes for bespoke orders based upon the brief you give me. You can show me pictures of a product produced by another cake maker but please note this can only be reproduced as my interpretation of that product and will NOT be an exact reproduction of the product in the picture or photo. It goes against my ethics to replicate another cake artist or pastry chefs work. I welcome mood boards with inspiration from art, fashion, colours swatches as well as cakes.

The images on the website are examples of our cakes. All our products are hand made and can be ordered in different sizes from those shown on the website, your cake may have variations from the website image.

If you have any queries or need to make any changes to an order please contact me immediately. Alterations and amendments must be submitted in writing. I will assess the request for an alteration, and endeavour to make alteration where possible dependant on the design and amount of notice given. I will let you know its effect on the price and any agreed timetable. Accepting any alterations is at the discretion of the Seller. Alterations requested less than 6 weeks before completion may be subject to a surcharge.

 

 DEPOSITS

A non-refundable deposit of 50% is required to hold your date at least 2 weeks prior to your event.

The remainder is to be paid no later that 2 weeks before the cake is delivered.

Where we have delivered what is quoted and invoiced, but the Customer does not accept the finished Product, the deposit Will not be refunded.

COMPLAINTS

In the unlikely event that you are unhappy with your order please contact me within 48hrs of receiving your order so that I can investigate the issue and come to a resolution with you. If you wish to make a complaint to us or let us know any concerns after receiving the Goods, please do so in writing. Evidence of any faults, damages or discrepancies should be included.

Refunds will be offered at my discretion.

 

UNFORESEEN CIRCUMSTANCES

Where the order is cancelled due to illness or any other unforeseen circumstance that affects my ability to deliver the ordered Product, the deposit will be refunded within seven (7) days of notification to the Customer.

FINAL BALANCE PAYMENTS AND DELIVERY

The balance is due at least 2 weeks before the delivery date, and before the Product leaves the premises. If the order has been made less than 2 weeks before the event full payment is required.

I do not accept cash payments.

It is the responsibility of the Customer to check they are happy with the product on delivery.  The Customer is responsible for ensuring that the product is stored as per our instructions to achieve best results for taste and quality.

 

 DELIVERY


I offer delivery for certain destinations. Delivery is charged at my discretion and is based on the distance.

Delivery will be carried out in a safe and appropriate manner. Once delivered to the customer and change of hands has been completed with the product in appropriate condition, it is then up to the customer to store and care for the cake as per our instructions. If anything is to happen to the cake after this exchange, I are not liable for any damages.

A delivery date and time will be agreed by both parties, and if the customer is not at location at this time and date, and we are not able to contact the customer, or a neighbours details are not supplied for safe delivery the product will be transported back to my premises and it will be the customer’s responsibility to collect the product.

A shelf life and Best Before Date will be provided on the Delivery Note. This is advisory only. Please note, once cakes have been cut into the shelf life will be reduced.

 

 PUBLICATION

I reserve the right to use any image of a Product made by us for publication at a later date.

 RETURN OF HIRED EQUIPMENT

Deposits are taken for all equipment. All equipment must be returned on agreed date or extra charges may be levied to cover hire costs. Any damages to equipment will incur a reduction of deposit returned in order to cover costs of repair or replacement.

Other Conditions are:

DAMAGE

If a third party will be collecting the cake on the customer’s behalf, a release form is to be signed by that person, stating the cake is received in good condition at the time of pickup/delivery.

The Customer is liable for any damage, accident, or mishap that may occur once the cake is released from the care and custody of the Supplier’s. The Supplier is not liable for any damage that may occur thereafter.

REFUNDS/CANCELLATION/POSTPONEMENT POLICY

POSTPONEMENT

If, for any reason the event is required to be postponed, please contact me immediately.

The new date proposed will be subject to availability.

CANCELLATIONS/REFUNDS

If cancellation of the order is required, and you have paid your full balance, the refund policy is as follows:

If the cancellation is up to one (1) month in advance of your event date, you will receive a refund, minus your initial deposit and the cost of any supplies already purchased for your cake.

If the cancellation is less than seven (7) days prior to your event, there will be no refunds given.

Refunds will be paid within 30 days of cancellation.

Please note: Any non-refunded balance may be credited toward future purchases
